Dated 28th June 1839 Will of Mr Baker Greenwell Will of Baker Greenwell This is the last Will and Testament of me, (suggest Baker as paper is decayed here) Greenwell the Elder of Wheatly (sic) Green, in the Parish Chester le Street in the County of Durham, Gentleman made this Twenty Eighth day of June, One Thousand Eight Hundred and thirty nine I give and devise all and singular my Messuages Tenements Hereditaments and real Estate, situate at Great Aycliffe in the County of Durham, with the Rights and Appurtenances thereto belonging for all my Estate right, benefit and Interest therein unto and to, and for the absolute use and benefit of my Son Baker Greenwell the Younger, his Heirs and Assigns for ever, I give and devise, direct and appoint all and singular my Messuages Lands Tenements and hereditaments called or known as by the name of the Wheatly (sic) Green Estate, and held of the Manor of Chester in the said County of Durham, and all and singular other my Copyhold, or customary Estates and hereditaments whatsoever, and wheresoever, the same may be situate, with the Rights and Appurtenances thereunto belonging for all my Estate, right benefit and Interest therein unto my three Sons and Daughter. To hold the same unto them, and their heirs, Sequels in Right and Assigns, according to the nature and quality of the said Estates and hereditaments, and the custom of the Manor, or Respective Manors whereby the same are holden, the whole unto four Equal parts or shares, being considered as divided, To and for the use of Atkinson Greenwell of Archdeacon Newton, in the County of Durham, Baker Greenwell the Younger of Barmton (sic) in the County of Durham, John Greenwell of Thornton Hall in the County of Durham, and Ann Hudson, Widow of John Hudson of Broomyholme in the County of Durham, subject to the payment of Forty Pounds per Year unto Hannah Greenwell my Wife for her life to be paid half Yearly. I also Will and bequeath to my Wife Hannah Greenwell the use of my Furniture, Plate and Linen for her life, and at Her Death I will the Household Furniture Plate and Linen to my Sons Atkinson Greenwell, one fourth part, to Baker Greenwell one fourth part, to John Greenwell one fourth part and to my Daughter Ann Hudson one fourth part. I also Will and bequeath all my Monies, Notes, and Receipts And all Securities, whatsoever, and wheresoever, unto my three Sons and Daughter, subject to the payment of a Legacy of Fifty Pounds unto my Sister, Mary Stephenson, the said Legacy of Fifty Pounds to be paid her within three Months after my Death. And my Son Atkinson Greenwell to receive one fourth part of my said Monies, Notes and Securities, Baker Greenwell one fourth part, John Greenwell, one fourth part, and my Daughter Ann Hudson of Broomyholme the remaining fourth part of all and Every of my Monies, Notes Securities whatsoever, and wheresoever. Provided also, and I do hereby further declare and direct that it shall be lawful to and for the said Atkinson Greenwell, Baker Greenwell, and John Greenwell their Heirs, sequels in Right, Executors, and Administrators, by and out of the Trust Monies, and premises which shall come to their hands, by virtue of the Trusts of this Will in the first Instance and before any payment, division, or other Appropriation thereof to deduct, retain, pay, and Satisfy, unto themselves, all Costs Charges and Expenses, which they shall, or may sustain, or be put unto in the Execution of the Trusts of this my Will or otherwise in Relation thereto. I give devise and bequeath unto my said Sons Atkinson Greenwell, Baker Greenwell and John Greenwell their Heirs, Executors, Administrators and Assigns, All Estates Messuages, Lands, Tenements and Hereditaments vested in me upon any Trust, or Trusts, To hold and dispose of the same according to the nature of and quality thereof in such manner as the same ought to be held, and disposed of pursuant to the Trust, or Trusts subsisting therein. And I hereby appoint the said Atkinson Greenwell, Baker Greenwell and John Greenwell my Executors of this my Will and Lastly I hereby revoke all former, and other Wills by me at any time, or times heretofore made, as well as all deeds, and declare this only to be my Last Will and Testament.
